Restraining orders are taken very seriously by law enforcement and the courts. Although,they are designed to protect a victim from an abusive partner, some victims use them to gain the upper hand in a dispute. Wrongful accusations can result in wrongful incarceration.

 

However, no it does not matter if the charges are real or trumped up, you must obey the "no-contact" provision of the order. "NO CONTACT MEANS NO CONTACT!" That means, no phone calls, IM, emails, letters, text messaging, etc. or having other persons contact the "victim" on your behalf.   If you violate the no-contact provision of the court order (either the TRO or the FRO), you may be found guilty of criminal contempt. The parts of the domestic violence restraining order that will be enforced by a criminal contempt charge are set forth in Part I of the order. In any of these cases, you may be charged with contempt. If you have violated the restraining order, you may be charged with contempt. And, ONLY A JUDGE CAN LIFT THE RESTRAINING ORDER.
